1. What MTOPS is

MTOPS AI ("MTOPS", "we") provides software: an automated analysis and trade-execution tool that connects to your own MetaTrader 5 account. We are not a broker, fund manager, or financial adviser, and using MTOPS does not create an advisory or fiduciary relationship. See our Risk Disclosure — it forms part of these terms.

2. Eligibility

You must be at least 18 years old and legally able to trade the instruments you connect MTOPS to in your jurisdiction. By using the service you confirm both.

3. Your license to use MTOPS

We grant you a personal, non-exclusive, non-transferable license to use the MTOPS software for your own trading account(s) while your subscription or beta access is active. You may not resell, sublicense, reverse-engineer, or operate the service on behalf of third parties without our written agreement.

4. No financial advice

All output of the system — forecasts, signals, decisions, logs, educational content — is information generated by software, not advice. Decisions to trade, and their outcomes, are yours.

5. Your account and API key

You are responsible for your broker account, your API key, and the permissions you grant. Keep your credentials secure; you can revoke the key at any time from your side. MTOPS never has withdrawal access — see our Security page.

6. Limitation of liability

To the maximum extent permitted by law, MTOPS is provided "as is", and we are not liable for trading losses, lost profits, or indirect or consequential damages arising from use of the software — including losses caused by market conditions, broker execution, connectivity failures, or software errors. Where liability cannot be excluded, it is limited to the fees you paid us in the preceding 12 months. Nothing in these terms excludes liability that cannot lawfully be excluded under South African law, including the Consumer Protection Act where it applies.

7. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.

8. Changes

We may update these terms as the product evolves. Material changes will be announced to active users before they take effect; continued use after that is acceptance.
